How can adultery be proven?
The court will allow the divorce if adultery can be proved. Unfortunately, proving adultery itself is often a tricky problem.
An applicant who files for divorce on the ground of adultery must produce evidence that adultery had indeed taken place to the court. The best evidence of adultery is video evidence of the act, which would be undeniable proof.
The applicant can also produce photographic evidence of the cheating spouse in intimate poses with a member of the opposite sex or spending time together in a hotel. This is evidence of the cheating spouse having the intention to commit adultery and having the opportunity to commit adultery. Such evidence, however, is not as strong as video evidence of the act of adultery itself.
