What are the duties of executors and administrators?

Executors and administrators have a duty to the beneficiaries of the estate of the deceased and should not take their duties lightly. The basic duties of both roles are:

  • To determine the extent of the assets and liabilities of the deceased.

  • To discharge the liabilities.

  • To act as diligently and as reasonably as possible to realise the assets under the estate and to distribute the assets.

  • To act impartially and with detachment in administering the estate.

  • To render proper accounts at the end of the administration.

To be certain on how to deal with the unique circumstances of each estate, it is best to advise an experienced probate lawyer on how best to discharge your duty as an executor or administrator.
