What do I do if the adverse party decides not to reply to the Letter of Demand?

The adverse party may choose to ignore the Letter of Demand, which is sometimes done to test if you are really willing to file a lawsuit. In such cases, it is still essential to document the demand and to let the stipulated deadline lapse. This is critical evidence that the adverse party had an opportunity to fulfil his obligation to you, but chose to breach it nonetheless.

More importantly, you now need to decide if it is worth your time, effort, and money to file a lawsuit to ensure the judgement is enforced. If you do decide to file one, you will need to pursue your claim in the correct forum. The possible forums that you can pursue a legal claim in Singapore are:

  • The Small Claims Tribunal

  • The Magistrate Court

  • The District Court

  • The High Court

A lawyer will be able to advise you on the different processes for filing a lawsuit in the different forums.
